1. Who we are and when these terms apply
My Spanish Advisor is operated by 123 Konsulent, Calle Pintor Sobejano 70, 30710 Los Alcázares, Spain, NIF ESY6488390N (“we”, “us”). Use our to reach us.
These terms apply when you browse the website, create a member account or use the portal. By creating an account, you confirm that you have read and accepted them. You must be at least 18 years old and able to enter a contract.
2. What the service does
My Spanish Advisor organises practical information for moving to and living in Spain. Depending on availability, the service may provide:
- a personal profile and suggested roadmap;
- plain-English guides and links to official sources;
- progress, appointment and document organisation;
- AI-assisted answers, document explanations and translations; and
- draft replies or help understanding form fields.
Features may be added, changed, suspended or released gradually. We will not materially remove a paid feature during a paid period without an appropriate remedy required by consumer law.
3. Guidance and AI limitations
Information can help you prepare and find the responsible authority, but it is not individual professional advice and does not guarantee an application, appointment, transaction or legal outcome.
- Rules, fees, forms and local practice can change or differ by office and personal circumstances.
- AI can misunderstand a question or document and can produce incomplete or incorrect text. Check important details against the linked official source.
- Translations are for understanding and are not sworn or certified translations. An authority may require a traducción jurada from an authorised translator.
- Draft replies and form help must be reviewed by you. We do not sign, submit, send or represent that a document has been accepted.
- For immigration status, deadlines, tax, litigation, large transactions, health or other high-risk decisions, obtain advice from a qualified professional.
Never ignore an official deadline while waiting for a feature or answer. If a document appears urgent, contact the issuing authority or a suitable professional promptly.
4. Your account
You must provide accurate information, keep your login secure and tell us promptly if you believe somebody else has accessed your account. You are responsible for activity carried out through your account unless caused by our failure to use reasonable security.
You may not share an individual account with unrelated users, impersonate another person, interfere with the service or attempt to access another member’s information. We may temporarily protect or restrict an account while investigating suspected misuse or a security risk.
5. Your documents and content
You keep ownership of documents, questions and other content you upload. You give us a limited permission to host, copy and process that content only as needed to provide, secure and improve the service you request.
You confirm that you have the right to provide the content and that doing so does not unlawfully reveal another person’s information or infringe their rights. Do not upload malware, unlawful content or information that is not reasonably needed for your request.
Your private originals are not made public. How we use and protect personal data is explained in our Privacy Policy.
6. Acceptable use
You must not:
- use the service for fraud, deception, unlawful surveillance or to create false official documents;
- upload content that is illegal, abusive or infringes intellectual-property or privacy rights;
- bypass security, probe for vulnerabilities, scrape the service at scale or overload it;
- resell, copy or systematically extract our guides, software or generated service content; or
- present an AI result as certified, official or professionally approved when it is not.
We may remove prohibited content or suspend access where reasonably necessary to protect users, comply with law or investigate a serious breach. Where appropriate, we will explain the reason and provide a way to contact us.
7. Fees and future paid services
The current account can be created without a credit card. If we introduce paid memberships or one-off services, the price, taxes, billing interval, included features, renewal and cancellation terms will be shown clearly before you buy. You will not be charged merely because you have a free account.
Any mandatory consumer cancellation or digital-content rights will apply. Additional purchase terms shown at checkout will form part of the agreement and will not reduce rights that cannot legally be excluded.
8. Our content and intellectual property
The website, brand, interface, software, guide structure and original content belong to us or our licensors. We give you a personal, limited, non-exclusive and non-transferable right to use the service for your own lawful needs while your account is active.
Official forms, laws and third-party pages remain the property of their respective owners. Links are provided for convenience and do not mean that an authority or third party endorses My Spanish Advisor.
9. Availability and changes
We aim to provide a reliable service but cannot promise uninterrupted access. Maintenance, provider failures, security events and changes to third-party or government systems can affect availability. We may change these terms for legal, security or service reasons. We will provide reasonable notice of material changes and ask for renewed acceptance where required.
10. Responsibility when something goes wrong
Nothing in these terms excludes liability that cannot legally be excluded, including mandatory consumer rights, fraud, wilful misconduct, or liability for death or personal injury caused by negligence where applicable.
Within the limits permitted by law, we are responsible for direct loss that is a reasonably foreseeable result of our breach. We are not responsible for a decision made without checking clearly signposted official or professional sources, for an authority’s decision, or for loss caused by inaccurate information you provide, your missed deadline, an external website or an event outside our reasonable control.
If you use the service for business purposes, we do not accept liability for indirect loss, lost profit, lost business, lost opportunity or business interruption to the extent permitted by law.
11. Ending your account
You may stop using the service at any time. You can permanently delete the account and member data from Portal → My Account → Delete account and data. See the Privacy Policy for deletion and retention details.
We may end or suspend access for a serious or repeated breach, unlawful use, security risk or where we must do so by law. We will act proportionately and, where reasonably possible, allow you to retrieve your content or contact support before permanent closure.
12. Spanish law and disputes
These terms are governed by Spanish law, without removing any mandatory protection you have under the law of your habitual residence. If you are a consumer, you may bring a dispute before the courts that have jurisdiction under applicable consumer law. Nothing here forces a consumer into arbitration or a court that the law does not permit.
Please use our first so we can try to resolve the issue. You may also use any public consumer complaint or dispute-resolution route available to you.
13. General terms
If one part of these terms is found invalid, the remaining parts continue to apply. A delay in enforcing a right does not waive it. You may not transfer your account or agreement without our permission; we may transfer the service as part of a business reorganisation or sale while preserving your rights and data-protection safeguards.
These terms, the Privacy Policy and any purchase terms shown before payment make up the agreement for the relevant service.
